Hello,

If an ENT doctor caused my eardrum to rupture during a ear wash procedure, can I sue him?

Possibly. You will need to have your doctor's records reviewed by another ENT to determine whether yours was a bad result, or the result of medical malpractice. Best, M. E. Zuller

In NY, a doctor has to certify that there has been malpractice. In your case, the issue is whether the injury was an accepted risk of the procedure. Also important is what the consequences from your injury are as medical malpractice cases are costly for lawyers to pursue. I am a former federal and State prosecutor and now handle medical malpractice cases so feel free to check out my web site and contact me to discuss your case.

Dental Malpractice is a special niche area of law. Nevertheless, the same standard applies in a medical malpractice case. Did the doctor deviate from the standard of care and was that deviation the proximate cause of your injury. Another element to consider is whether you have serious damages or injuries as a result of the this malpractice that has some level of permanency. Is your ruptured eardrum permanent? If so, what is the level of hearing permanently lost. Is a ruptured eardrum a risk to the procedure?
