Legal Question in Medical Malpractice in New York

hospital D/C W/ life threatening condition W/O pt knowledge

I was discharged from the hospital after a syncopal episode with collapse. I was told i fainted. they did cardiac tests. I did have heart failure, but they neglected to tell me. I went to a cardiologist of my own accord. He wondered why it took the hospital so long for me to be seen. He said,''you don't know you have heart failure?''

Medical malpractice cases involving failure to diagnose situations are driven by the liability (who is at fault) and the damages (measure of extent of your injuries). You may have a strong argument for a failure to diagnose but what is your current state? That is, what is the extent of your injuries. There are many questions I must ask to determine whether you have a claim for medical malpractice and specifically a failure to diagnose. If there were no further injuries connected to the hospital's failure to advise you of your medical condition, a malpractice case would not likely amount to much. Best, M.E. Zuller
