Legal Question in Medical Malpractice in New York
Implants
In May of 2005 I had a new dental procedure performed on my upper jaw. It involved removing my
remaining eight teeth and attaching a permanent prosthesis similar to a denture on four implants.
The process normally takes three months. Due to endless problems with placement and production of the prosthesis it took eighteen. Six months after it was finished, it fell apart. When my dentist was trying to fix it he accidentally pulled out one of the implants, ruining everything he did over past two years.
I am forced to go to a different dentist and start the procedure all over again at a cost of $30,000 to $40,000 including the cost of bone grafts.
I was the first patient on whom he performed this procedure. I suspect one of the reasons the implant failed, was the fact that he placed the temporary teeth on two implants instead of four for twelve months. During that time he was trying to make the permanent piece, but it effectively doubled the stress on the implants.
Is this worth pursuing?

Re: Implants
Generally, a full denture requires 4 implants as you noted. At worst, the dentist may be responsible for the cost of the new procedures. He/she may be liable to you for pain and suffering as well. I have years of experience handling dental malpractice cases and would be happy to speak to you about your case. You can call me at 2129725252.
Re: Implants
It could be. At a minimum, you have to repeat the process. Did you have any pain as a result of what went on. If you are interested in proceeding, I would put you in touch with a former dentist who is now a practicing attorney and handles these type of cases on a regular basis.
