Legal Question in Medical Malpractice in New York

liability of therapist named in summons complaint against hospital, who does not

I am a case manager-therapist working in a psychiatric hospital. A client who was treated for Post-Partum Depression and discharged killed her child two weeks later and is being tried for murder. This happened almost two years ago. Today I learned that the hospital is being sued for negligence by the family. I, the case manager, and the psychiatrist, are named in the summons and complaint. I have been instructed that I am covered under the hospital's insurance. I do not have any liability insurance of my own and have no assets, make twenty-dollars and hour, do not own a house or car, and have virtually no savings. I cannot afford a lawyer. What are my responsibilities assuming I receive a seperate summons that names me? Thanks for helping!

First, as an employee of the facility, its coverage should cover you.

Accordingly, you should ascretain this.

Next, if served, immediately make a copy of the papers, keeping the original for yourself and turning the copy over to the proper facility department, i.e., risk management legal, etc.
