Legal Question in Medical Malpractice in New York
Medical error
About year and half ago i had a situation whereas, i was bleeding during my pregnancy and i went to the e.R. And explained that i was have complication, the doctor did ultrasound and took blood from me. The doctor then said, that everything was fine so i could go home, she said, she hear a normal heart beat for the baby. The following day i went to work in the morning and i started to experience some pain in my abdominal area . I called my husband to pick me up from work because of the pains that i was experiencing, so i went back to the e.R. At montefiore hospital . While i was in the e.R. The pain started to increase, that is when i told my husband to call the doctor the pain was too bad. At this time, i felt like i had to use the bathroom, so when i sat on the toilet i had a miscarriage following a pool of blood. I explained to the doctors what had happen in the bathroom. Once again they told that this was normal that i would be okay. I feel psychologically impaired when i think about the situation because of the medical error of medical professionals i entrusted in the welfare of my unborn child. I will like to know if an attorney can help with this case.

Not sure there is a case. The issue seems to be whether anything could have been done to prevent the miscarriage. It would take an ob/gyn to review the chart and decide. The statute of limitations is 2 and one half years from the day you were sent home from the ER. If you wish to pursue the claim, don't wait much longer. Best, M. E. Zuller
