Legal Question in Medical Malpractice in New York

Medical Malpratice

I've recently settle a wrongly death suit against an unamed hospital in New York. My attorney has received a check for teh settlement amount, but informed me that I now have to wait for the Surrogate Courts to allow him to disperse the money which can take several months. Is this correct the suit was in Queens County

If your attorney has gotten you a settlement against a hospital, I would not second guess him. To answer your question however, the surrogate's court and the civil court can be different. One court is for the lawsuit the other is where the estate has been probated or where the estate should be probated.
