Legal Question in Medical Malpractice in New York
Misdiagnosed at the dentist
I went to the dentist for front tooth pain. Without xrays he tells me I need braces because my bottom front tooth is hitting my top front tooth. He quoted me a price of 7,800.00 He cleaned my teeth and I left. When my tooth continued to throb for the next week, I sought a second opinion. The 2nd Dentist took xrays, determined I had severe nerve damage and infection in the pulp. Can I sue that first dentist for misdiagnosis?

Re: Misdiagnosed at the dentist
A successful dental malpractice claim combines a departure on the part of the dentist, coupled with a serious or permanent injury. That the correct diagnosis was made within a reasonable time (presumably) by a second practitioner, and proper treatment rendered, saved you from serious injury. Best, M. E. Zuller
