Legal Question in Medical Malpractice in New York

nerve damge atter lumber spinal fusion

the doctor did my fusion ,the hospital never tok out the catheter until 9 days later. the doctor also broke the tube in my back. then i was left in the hospital for 28 days and i now have cauda equina syndrome. they never prefomed a myelogram just an mri and a cat scan .the surgeon just dumped me off to the esidnts . Do you think this is alpractice?
