Legal Question in Medical Malpractice in New York

Trying to obtain medical records

I am trying to obtain my medical

records from a radiologist's office

with no success. I have been trying

for over a month and every time I

call I get the same answer and run

around. ''They are in storage and

we'll have them next week'' but I

never got them. I then realized that

when I had the mammogram, this

particular office was under

investigation by the New York State

Dept of Health for misinterpretations

of films by inadequate staff. I can

only think that the reason they are

not giving me my films is because

they don't want to be liable for any

misinterpretation that may have

occured with my records. I just want

what is rightfully mine so I can take

them to my new radioligist for a side

by side comparison. I don't know

what else to do to get my records, so

any advice would be very helpful and

appreciated. Thank you.

File a complaint against the radiologist with the Office of Professional Medical Conduct. Be sure to copy the radiologist on the letter. Once they receive the complaint, I bet you will get your records ASAP.
