most Personal injury cases have a 3 year statute of limitations not 2. wrongful death cases have a 2 year statute. Medical malpractice has a 2.5 year statute. As with all statutes of limitations there are certain factors that can delay the start of the time running. This is called a tolling of the statute. With more information an attorney can help you figure out what statute is applicable in your case, and also if any factors allow for its running to be tolled.
