Legal Question in Medical Malpractice in New York

phlebitis

i was in the hospital for a serious throid and heart problem and while i was there i contracted phlebitis i didnt find this out till 10 days later when i started feeling weird pains up and down my arm burning sensations and a slight fever i brout my medications to the emergency room and they informed me that i have phlebitis and to put a warm compress but this diagnosis was if you did not have a blood clot on top of that they wanted me to stop taking my thyroid and heart medicine do i have some kind of case i will be returning to the hospital because now i feel my veins are on fire what do i do?

Please accept my sympathies for everything you�re going through.

One of the most important considerations in whether you may have a legal case for medical malpractice is whether you have a permanent injury. This is unclear at this time, as you are currently being evaluated and treated for this condition.

Personally, I would not investigate a medical malpractice case based on the facts that you are presented.

Typically, in phlebitis, the patient notices a problem immediately. You did not notice a problem until 10 days later. While it is possible that this may have been avoidable with proper attention early on, the fact that you did not notice it for this extended time, raises questions about what the nurses could have seen early on to clue them in to the problem.

This is my opinion only, and I urge you to inquire further if you believe you might have a case.

You are apparently describing a recent event. Be advised that there are strict time limits on all lawsuits, so that you need to inquire with an attorney as early as practical, if you are to preserve your right to sue.
