Legal Question in Medical Malpractice in New York

severe allergic reaction in allergists office

I've been going to an allergist for 3 months. I go once a week. last week I didn't go, and oddly the back of my arm swelled with hives. When I went this week, I told the Dr. and he said it could've been anything and that it would be ok to give me the shot. Immediately after getting the shot, I had a sever reaction. My throat closed, couldn't breath and blood pressure dropped. I had Dr. call my family. The office staff told my family it was a mild reaction and that I would be home 20 minutes later. They would not let my family speak with me. I had no idea that my family wanted to speak with me. My family insisted they put me on the phone, but they wouldn't. My family asked the Dr why he gave me the shot after having a reaction last week, he gave them a brief non specific answer. He told them I was having a little difficulty breathing, when in fact my throat was closing, and I felt pressure in my ears and head. Difficulty breathing as well as dizzy.

If the allergic reaction passed, without any sort of serious or permanent injury, it would not, in my estimation, justify a medical malpractice lawsuit. If you believe an investigation is warranted, contact the NYS Health Department and report the details of the incident. Best, M. E. Zuller
