Legal Question in Medical Malpractice in New York

My son who was 17 years old at the time had hernia surgery in October 2010 and has been diagnosed with nerve damage. He has penis, testicle and right leg chronic pain. He also has pain urinating. Not one doctor has helped with this pain. We had every test you can think of and have seen every doctor. He still has the chronic pain and it is going to be 2 years soon. We sought legal counsel with 2 firms, but stated we did not have a case. Why when my son walks with a cane. We have a wheelchair for doctor visits because he can't walk or stand for long periods of time. I just want justice for my son. He is now 19 years old and still suffering with pain. His youth was taken away from him. He had to stop attending high school. He will never experience prom or feel the pride walking down the isle at graduation. We need help. We need justice.

From what you describe, and given the opinions of two law firms, it appears that your son had a bad result from the surgery performed. It is crucial to understand the legal distinction between a bad result, which might obtain even when everything is done properly, versus medical malpractice, which is a departure from the customary standard of care. You might try having the medical records reviewed by another urologist, perhaps one practicing in a different state, to see whether he/she can find any departure from the usual standard of medical care.
