Legal Question in Medical Malpractice in New York
Unhealed Wisdom Tooth Extraction
A little less than 2 years ago I went to my dentist with tooth pain. It turned out to be a cavity, which he would not fill until I had an impacted wisdom tooth extracted. Mind you, the wisdom tooth was causing no pain at all. But, needing my cavity filled, I went to a Dr. Laurie Cohen, who struggled to remove the deeply impacted, yet completely unpainful, wisdom tooth. I was not healing, despite a couple of quick follow up visits. It was at this point as a bone shard about the size of a dime broke from the section of my jaw that she has cut into, and was working its way through the gum tissue, finally jutting out of the gumline at the back. Dr. Cohen pulled out the shard, no stitches. I returned several times over the next several months because the wound was not healing. Dr. Cohen attempted three bone grafts, each failing in a matter of days. Each time I was left with a larger open hole at the back of my gumline, a very large hole in my jaw, and pain everytime I move my jaw, impacting my singing career. In the less than 2 years since, I have developed other tooth problems, which will need treatment, and constant, all-day pain that I truly feel is connected to the unhealed bone and tooth canal. Do I have a viable lawsuit?
