Legal Question in Medical Malpractice in New York
hello, I wanted to know, am I able to sue my dentist. I had oral surgery October 12, 2011. I went to the dentist on the third on November and told him I have an infection, in my mouth. (after following his directions exactly) He told me everything is fine today is the sixth of November an I have pus in my mouth exactly where I told him it was infected in the first place

I always like the question "can I sue?" That Answer is almost always yes. The question with a dental malpractice case is whether the dentist "departed from the standard of care". Given the short period of time between your treatment and ths inquiry, I would think it diffucult to bring a claim. I would return to the dentist as soon as possible or see another. Infections are sometimes tricky and different people do not have the same result to anti-biotics or other forms of treatment.
