when&how to file a suite &what form(not small claims)

Is there time limits to filing a medical malpractice law suite? When the patient requires corrective surgury also. What claim form could be used when claim is not a small claim?Is there a telephone number to order the form with?

2.5 years if non municipal defendant is Statute of limitations for medical malpractice in NY. In order to really know the actual date by which suit must be filed, you should schedule a free consultation with a malpractice lawyer. Even if you do not want to hire one, they will calculate the date for you as part of the consultation for free. then you will know for certain. There is no generic form for a malpractice complaint in Supreme Court. In addition other documents must be filed in conjunction with such a complaint in order to properly commence your suit. you can do it yourself but having a good lawyer look at it will be helpful in clarifying the issues you face.
