Legal Question in Military Law in New York
Can a non Academy Cadet be charged under Article 133 and 134 of the UCMJ. I am now an Army Officer and am being investigated for something I did while in ROTC.

Reserve Officers' Training Corps (ROTC) cadets and midshipmen are by law exempt from the UCMJ (even while on active duty for training such as CTLT, LTC, LDAC, or while attending various training schools such as Airborne School, Air Assault School, Mountain Warfare School, etc.).
The question, however, might turn to whether there is anything for you to be concerned about in this investigation that might qualify as a potential charge(s) under State or Federal Law.
