2 US Citizens involved in a serious car accident in the UK
I am a US military member living in the UK. In June of last year, I was involved in a collision with a dependent spouse of another military member, also a US citizen. The police found her to be at fault for the accident. I was nearly killed. I suffered a broken collarbone from the seatbelt, a laceration on my head and both knees were almost shattered. It has been 11 months and I still can�t run without problems. The person who caused the accident moved back to the US about a month after the accident. Is it still possible for me to sue that individual because of dramatic change in my life caused by the injuries I sustained? Working out and being active was my whole life, especially with me being in the military and now my activities are very limited. I cannot take my annual physical fitness test with my job because I cannot run; I have a hard time working out because of the damage to my shoulder with my collarbone and it has affected me mentally as well. Yes, you can bring a lawsuit against that person, but there are two major problems: 1) jurisdiction - you must bring the lawsuit in the state where she lives, where the accident occurred or where she has significant contact (the last part is a technical issue in the law; and, 2) does she have insurance coverage for this event. These issues would have to be reviewed with you.
