Legal Question in Personal Injury in New York
it's been 3 years and my lawyer won't return my calls.
what should i do if he wont talk to me and iv'e already signed a retainer for him to get 30%.

You have the right to terminate your lawyer for cause. Hire another one. You will only have to pay the new one.

A client is always free to change lawyers. If your lawyer is not returning your calls, that is likely grounds to discharge for cause meaning he would not get a percentage of the legal fee from the new attorney.
