If your doctor says the injuries are caused by the accident you have a potential case against the other driver. In a motor vehicle accident case in NY, you need to show "serious injury" as defined in the Insurance Law. I am a former federal and State prosecutor and now handle accident cases so please feel free to check out my web site and contact me if you wish to discuss your case.
As long as your injuries to your neck and your knee are causally related to your motor vehicle accident you have a case against the driver for pain and suffering. Your medical bills will be paid by you insurance company via the No-Fault law.
