Legal Question in Personal Injury in New York
accident
Was stopped at a traffic light & hit from behind, causing me to hit car in front. Hurt my neck, shoulders, fat lip & burns on hands from airbags. Doctor took x-rays, says I am very lucky, Had spinal fusion 4 years ago & hardware is intact. Doctor says soft tissue injury is very hard to prove considering I have a pre-existing condition, & sent me for physical therapy. Insurance company is offering $700.00 for bodily injury. Does this seem fair?

Car accident lawsuits involving injuries not considered "serious" can be, and often are, dismissed. You should probably not hurry to settle until you are sure there are no physical complications from the accident. Best, M. E. Zuller

Under NY law you must prove that you sustained a serious injury to recover for injuries sustained in an auto accident.Serious injury is a defined term with different categories under the law - depending on the nature and extent of your treatment you may qualify - if you would like you can call for a free consultation.

I am very sorry for your terrible ordeal. The offer made to you is incredibly unfair and it is the insurance company's attempt to make you settle for pennies. Do not accept that offer. It is important that you hire a lawyer or at least go for a free consultation. A rear end accident clearly places liability with the other driver. The next question is, what are the extent of your injuries. I believe you should be thorough with your medical follow up to make sure your pre existing condition is fully intact.
