Legal Question in Personal Injury in New York

accidents

I was involved in an accident last year. according to the police report. I was the only person with an injury and the person who hit me was ticketed for failure to yeild. the police reportalso stated that the only reason the accident occured was because he did not yeild. now he is suing me. my auto insurance has assigned a lawyer to the case but they have advised us that we have the right to hire our own attorney as well. Should we?

If you were seriously injured you should hire a lawyer, on contingency, to pursue a pain and suffering claim against the other car. You may also hire your own lawyer to oversee the insurance company lawyer, but this would not be a contingency fee arrangement and is not usually done by individuals. Good luck. Best, M. E. Zuller

If you want to be compensated for your injury, then you should hire an attorney for that. I would have to know more about your injury, and where this happened, to say whether we would be interested.

You are probably fine letting the insurance carrier's attorney defend the law suit against you. However, if you want to sue the other driver for your injuries, you need to retain your own attorney as the insurance company attorney won't do that for you. Whether you have an injury worth pursuing depends on whether you have a "serious injury" as that term is defined by law. Please feel to contact me if you want to discuss your options. The answer depends upon the extent of his injury and the extent of your insurance coverage. If you have limited coverage you should retain your own attorney, as your interests may differ from your insurance carrier.
