Legal Question in Personal Injury in New York

Hi my name is Anthony. In 2009, I was in the hospital where I Contracted Hepatitis C. I was heavily drugged up on the drug Haldolperidol and was not aware of my surroundings and environment. I had this guy harassing me and he wouldn't leave me alone. He had hepatitis C and punched me in the face. He had an open wound on his knuckles and I contracted the virus. He is a known sex offender and the staff did nothing to get him to leave me alone. One of the reasons they did not put him in the criminally insane unit ITU is that they watched movies up there and he liked it so they didn't know what to do with him. He was a nuisance to everybody, Is there anyway that I can sue the hospital for the cost of my treatment? The hepatitis has an expensive treatment where the cure has a cost of $1000 a pill for 3 months. Which comes out to a 84,000 treatment. I have Medicaid and Medicare but I doubt they will pay for the treatment because my liver disease is not advanced. Another reason I am suing is that it is harder to make a relationship with my family because of this because there are lots of kids around and none of them want to be around me and treatment me differently because I have the hepatitis. So, as you can see, there is some pain and suffering involved. I have lived for the past 5 years with it. What is the statue of limitations on suing this hospital because I really think they should pay for my treatment.

The statute of limitations (SOL) is almost certainly a bar to any litigation at this point. In New York there are a couple of ways around the bar of a SOL, but they are very highly fact specific and must be affirmatively plead and proven. Consult a local Attorney immediately with your medical records in hand.
