Legal Question in Personal Injury in New York
Arbitration vs. attorney
Last month we were in an MVA, where we were hit from behind, and not at fault. My wife has a claim against the insurance company, but, as of yet, I do not. I am ok, with nothing physically wrong, but I would like to recover the losses that occured, the vacation that was ruined due to the accident, purchasing new child saftey seats, and the cost of securing a rental until the insurance company put us in one. Do I need to obtain an attorney for this, or is it possible to make a demand on my own behalf. I consulted legal advice, but all they want to do is send me to doctor after doctor, and I dont need one. I am just looking to be compensated for my losses. What are the odds of the insurance company making me an offer?
Thanks,
Billy

Put in a claim against the other party's insurance company for your damages. They may reimburse you for some of your losses. If not, you can sue in small claims court. Good luck!
Re: Arbitration vs. attorney
What you are overlooking is that arbitration is for disputed no fault bills; you are looking for compensation for property damage or personal injury, things that are not covered by no fault.
Unless something hurts, there will never be an offer, that is number one; and if there were one, in the event you made such a claim, in order to get any money you would have to sign a general release, that would preclude you from ever suing if, in a year or two, you discover you herniated a disc or injured your knee.
