Legal Question in Personal Injury in New York
My attorney has been going to court for ten years with my case. I was sent to the doctor by the defense attornery. In which I went. My lawyer tells me that is all, now we have to wait for the outcome. Which was dissmissed because they say that I never went to the doctor that was requested by th defense in, which I DID. I think this is unjst and want to know if I would be able to get a re-trial.

Are you saying that you indeed did go to the defense's IME doctor and they told you that you did not? Well.... Did you have any witnesses? How many times did they try to reschedule? I am puzzled as to why the court dismissed your case unless you were told to go many times and did not show up. This is very odd.
Why is your case 10 years old? Even if you didn't go to the exam, that should not result in dismissal - there an appellate case on that this wee'm
