Legal Question in Personal Injury in New York

My ;awer wants me to continue to lie

I recently had an accident in my apartment building sending me to the ER at a local hospital. I was in pain, and still am. I went to a lawyer that I used on a case for my son, whiplash without a culprit. On relating the facts of my fall my lawyer mused over the facts that I have been retired for over 20 years with spinal damages suffered on the job. When he sent me for consults or MRIs he told me to not mention the fact that I am on Medicare and have previous injuries. I don't like lying by omission. How do I get out of this relationship with the minimal amount of lost monies?

In situations like yours, the prior injuries will be discovered by the defense attorney, possibly through health insurance and/or Medicare records or a doctor's report that mentions it. You don't need to bring attention to your prior injury, but don't deny that you had one.
