Legal Question in Personal Injury in New York
Bad Faith/Personal Injury Claim
I was involved in an accident that was definitely not my fault(all the evidence points to this). My insurance says 0% liability on my behalf but now the other insurance says that the driver of the other states that I ran into him. They claim to have a witness that says I also ran into him and I was on my phone(both lies).Other than a personal injury case,do I also have a bad faith claim, due to the fact that the other insurance company failed to properly investigate this accident?

Re: Bad Faith/Personal Injury Claim
No bad faith at this point. The other insurance company will do/say whatever it can to avoid paying if you were not at fault. If you were injured, I suggest speakin with a lawyer. My firm handles these cases on a contigency basis so feel free to contact me. Don't forget you need to file an applicaiton for no-fault benefits within 30 days of thte accident.
