Legal Question in Personal Injury in New York
Bar Assualt
Last summer I was followed out of a bar, jumped from behind and knocked out. He then shattered my jaw. He got away. The bar copied over the video tape that filmed the incident. I am now $25,000.00 in medical bill debt. My question is do I have any chance at a suit against the bar? The assualt happened in their parking lot right at the bottom of their steps which I was pushed off of.

Re: Bar Assualt
If you can prove that he was intoxicated, that the bar knew/should have known he was intoxicated and continued to serve him alcohol.
You will need witnesses that saw him drinking in the bar. Did you see him drinking before the attack? (You can be the sole witness)
If you do not have any witnesses you should still bring a claim, perhaps they would pay your medical bills to settle.
Re: Bar Assualt
The short answer is MAYBE. You would have to pursie a Dram Shop action against the bar -- a claim that the bar allowed the other person to drink too much. These are very fact specific cases. Did you report the incident to the police and bar? Did the police investigate. Does the bar acknowledge that it served the person who attacked you? Also need to consider what lead up to the fight. Did you have an altercation or words with the other person in the bar. Please feel free to contact me if you wish to discuss the case.
