Legal Question in Personal Injury in New York

two boken wrists caused by being pushed off a porch

back in august of o3 i was pushed off a porch by an ex-boyfriend, broke both my wrists, lost 3 months of work and am still in pain and under the care of a doctor. he had no home owners insurance and was drunk at the time. there were no witnesses and the only one he ever told about what really happened was his 24 yr old daughter. i have told no one. i never pressed charges

told the doctors that i fell.

he is also my boss at work.

i think i would like to sue him, but am afraid of him and the consequences that would follow, because he is my boss.

There is so much you have not said in your email. You must find a local lawyer and talk openly with him/her. Lawyers don't judge people and we don't care about these kinds of moral issues. But to win your case, your lawyer needs to know what happened and what is happening.

I think you have stopped seeing him. That is ok. But does anyone know that you and he were seeing each other? Were you a 'public' couple?

How big is your office? is he the owner, or just a midlle manager. Does the company know?

Maybe the easiest thing to do is file with the ny State Div of Human Rights claiming that he threatened to fire you if you sued for the injury. Or he used his position as your boss to make you continue or start to see him socially.

find a lawyer and talk openly.

good luck.

Re: two boken wrists caused by being pushed off a porch

You need to consider whether your ex-boyfriend has enough assets to make suing him worth while. Two broken wrists has value. Does your ex-boyfriend have money to hire a lawyer to defend the case? Does he own the home and if "yes" is there equity in it? If he pushed you intentionally, he could not discharge a judgment in bankruptcy. The fact that you gave the doctor a different story is an issue but not insurmountable - obvioulsy you feared your ex-boyfriend because he is your boss. My office handles these cases on a contingency basis. If you would like to discuss your case, please feel free to call me at 212-622-7180.
