Legal Question in Personal Injury in New York
My brother is incarcerated outside the state that I live in. He recently told me about a female staff who has taken advantage of him repeatedly. She's threatened to go to his case worker if he doesn't continue to have relations with her. I'm infuriated and I don't know what to do. My brother is embarrassed and doesn't know how to make it stop. He's really trying to keep his time problem free! Since she is in a position of authority over my brother can't I sue the department of corrections and her personally? This is just like the priests in the catholic church! HELP!

I have had this situation as well. In my case, the teenager was retarded and one of the older female staff members made him have relations with her for several months. The problem with these cases is that it is hard to convince any jury that a boy was forced to have relations with a female. They still hold antiquated ideas of male/female relations.
