Legal Question in Personal Injury in New York

burned hand at work

I received 2nd degree burns on the top of my hands while at work. I am a freelance cater that receives a 1099 from my employer. I was at an event location when I was casually walking by a panini press machine that was turned up high that was being operated by another employee. My hand unknowlingly brushed up against the machine in which I received 2nd degree burns on the top of my hands. I have been home for the past week feeling sick and upset about the burn and the scarring. Can I sue to recover for damages done to my hand..

Re: burned hand at work

You should either have a workers' compensation case or a personal injury case but likely not both under the facts you explained. You could receive a nice settlement in the comp case becuase you hurt an extremity. We are the largest workers' comp firm in NY (with 10 local offices) and we also have a negligence department so we can probably help you once we know more facts. Please feel free to contact me.
