Car Acc. fractured coccyx

Hello,

On Feb. 20th I was on my motorcycle heading north bound on a One-Way street with two lanes, me being in the left lane. A TLC Cab made a left turn from the right lane with out any signal hitting my right side rear end. I'm a live and well. I suffered a fractured coccyx, and well not be able to work until I don't know when? Is there a ball park figure on this type of case of should I just lick my wounds.

There is no real ballpark figure, but a good guess would be 2-3 times the amount of money that you would have made if you didnt get hurt and were abletowork, plus the amount of lost wages times the percentage that the other party is negligent. Liability sounds good so recovery will depend on the severity of your injury and the damages that flow therefrom. Some insurance companies are easier to deal with, so just who insured the taxi

may affect the settlement. I assume you are under the care of a doctor. Good luck.

There are 2 issues in making an assessment on the value of a case like yours. The first issue is the liability or fault of the TLC car, which in your case sounds very much in your favor. The second issue is the damages aspect of your case. The factors which will determine the damages aspect of the case are (1) how much money you lose from missing time at work; (2) your pain and suffering; and (3) your loss of enjoyment of life (activities that are restricted/you are unable to do) b/c of this accident/injury.

A ballpark figure is almost impossible to give in your case b/c much of the value of your case will be determined by the recovery you make.

This is a serious accident. Moreso because you don't even at this time know the extent of your injuries.

My guess is $35,000 if you make a complete recovery in 2 months and another 10,000 for every month up to 9 months. After that, probably 250,000 dollars provided you make a complete recovery. If you are unable to work at all, or are confined to a wheelchair, then it depends on how much the jury likes your lawyer up to 3 million.

Of course, in the meantime you can get your current medical bills paid by the 'no-fault' system and some lost wages. You can also collect either workers comp or ssd while you are unable to work.

The 'no-fault certification must be filed before March 29, 2005.

Don't lick you wounds, you are entitled to recover for your pain and suffering, lost wages, and any out-of-pocket expenses such as medications and taxi-cab fares. The important first step is to make sure that your application for No-Fault benefits gets filed within 30 days of the accident. Under No-Fault, you are entitled to have your medical bills paid (up to $50,000) and to receive compensation for your lost wages. Please be sure that you hire a lawyer asap so that you comply with the 30-day perod. I would not send the form in without showing to a lawyer first. At my firm, we help the client prepare the form and then mail it for the client certified mail, return receipt requested so there is proof it was mailed timely. As for your damages, it is too early to tell how much money you can except to get. It will depend on whether or not you need surgery, physical therapy, how good your recovery is and how long you are unable to work.
