Legal Question in Personal Injury in New York

what happens after a car accident?

what happen when you hit someone with your car and you have the light? would it help to have a witness who saw the whole event and told the police you were not at fault? does the pedestrian have a case against you? how strong would it be? beside paying for his medical fees what other fees would the driver be looking at?

Typically if you have the light, then the law is on your side. NY Vehicle and Traffic Law says that you have the right away. However, with that being said, you cannot just run into a pedestrian if you had an opportunity to prevent the collision.

A witness would help, of course, and how strong their case is depends on what more specific facts are.
