Legal Question in Personal Injury in New York

car accident

I was hit by a box truck on the LIE. My 2005 new minivan (I bought new in 2005) was totalled. I physically did not get hurt except for emotional trama. the insurance co. is only giving me the NAdA book value. can I sue the company directly for the rest of what it will cost me to buy a new car and for emotional distress? Yes i am seeing a psychologist due to the accident.

Thanks to no fault, pyschological damages would have to be huge to get past the threshold for no-fault. As for the new car, you are entitled to go after your out of pocket expenses.
