Legal Question in Personal Injury in New York

car accident

A perdestrian is hit in the middle of the street, and the driver has a lapsed car insurance. The pedestrian is out of work(9 months and counting) ,and in theorpy. There is no income coming in to the victim. Is there a way to sue for pain and suffering with the cost of lost wages to the victim? Also is there any other liabilities that fall on the defendant accused of the crime?

Pain and suffering, compensation for actual injuries, future pain and suffering, medical care costs and lost wages are possibly available in a civil action, among others. The thing is, does this driver have any source of assets from which you could collect, assuming there is a judgment in your favor?

I recevied your post on 11-5-2000.

First, make sure there was a police report.

Next, your own car insurance company should be contacted.

Also, a claim should be made against the Motor Vehicle Accident Indemnfication Corporation, a quasi-state corp.

You may be too late however, as you mentioned 9 months have elapsed, and the claim must be made as soon as practibable. Make the claim any way, you have nothing to lose.
