You very well may be able to sue. In NEw York it is necessary to meet a certain threshold for your injury... even with just a few days of missed work, there still may be what is termed soft tissue damage which could have long lasting effects... which are required as a bare minimum in NY cases... this is in order to weed out the cases the Court does not wish to spend time on... as there are so many cases filed in NY Courts.

Overall, if you have any pain, if you feel a need to continue with therapy... then you should seriously consider a suit in order to cover for your damages and pain, also more importantly - you should be sure you were not wholly the cause of the accident...
