Legal Question in Personal Injury in New York
I was in a car accident and suffered a cervical herniated disc confirmed by an EMG and going for an MRI--I was first car in five car pile up--accident was in NY and I live in CT--I am wondering what my case may be worth--I am 42 years of age--female--in pain but not out on disability--otherwise healthy--no problems pre-existing accident-
I was wondering where I should obtain an attorney-NY or CT?
Wondering range of what I might be offered in a settlement or at trial?

Its hard to say what the value might be without knowing more about how the injury has affected your daily life; lost wages, etc. It also depends on who was at fault in the accident. As for an attorney, if you aim is to just try and settle for anything you can get, a CT attorney is fine. However, if you forsee starting a lawsuit if you can't get a fair settlement, then you should use a NY attorney. I handle these cases on a contifency basis. NY, The law requires you to prove a "serious injury" before a jury can compensate for pain and suffering. I can refer you to one of the top NY firms that I work with to pursue this matter. Good luck.

I agree with the previous answers. Proving liability should not be a problem - you were rear-ended. The problem is whether or not you breach the serious injury threshold. When did the accident happen? Are you still treating? These are some questions that need to be answered. I regularly handle this type of case. Feel free to contact me to discuss this further.
Due to the number of vehicles in the accident you should have a New York attorney.
The case will almost certainty be filed in New York.
With regard to the amount of a settlement or verdict for your injury, it will depend on your recovery and your lawyer.
We have a lot of experience handeling cases like yours and know that the extent of the injury often can result in substantial recoveries.
