Legal Question in Personal Injury in New York
Car Accident
My 21 yr.old son was in an accident with a friends car. He was on a back road at night after it rained, there were no speed limit signs nor any curve ahead signs. He totaled the car and was injured as well. He broke his hip and ankle and required surgery. He received 3 tickets as a result of this accident. One was for unlicensed operator, but he does have a valid license. Another was bald tires, which they were, but he didn't know it and the last one was unsafe speed, no speed limit signs...I don't get it. Should we get a lawyer for his upcoming trial for the tickets? Should we also check into a lawyer for pain and suffering, he's out of work for at least 3 months. Thank You

You should definitely have a lawyer for a civil suit. You have a cause of action against the owner of the car for lending the car bald a tire, and you very may well have a suit against the village or municipality that is charged with upkeep of the roadway.
Your civil lawyer should then help you find a criminal lawyer to handle the traffic ticket, or visa versa.

You should have a lawyer for the speeding tickets because generally the traffic court and its prosecutors treat the defendants better whey they are represented. If his driving record is otherwise clean, he may be able to plea down his tickets and simply pay a fine and receive a reduced amount of points. As for a civil suit, your son may have a cause of action against the town/city who designed and maintained the road. I'd be happy to speak with you and your son further.
