Car hit in back by taxi resulting in injury to car driver & damage to car-taxi c
Six days ago, my husband stopped behind a driver at a red light. Almost immediately, a taxi at high speed slammed into my husband, ramming his car into the one ahead. His car was squashed and he was injured. He has seen doctors, missed work & sought physical therapy. The taxi co. has refused to do anything. Our insurance co. & the insurance co. of the 1st driver have had their calls go unanswered. Do we have any legal recourse? My husband's car has been damagd, his health has been affected, & he has needed to rent a car for his return to work. Would any lawyer be willing to take this case on a contingency basis? Neither one of us has ever sued anyone before.

I would certainly be interested in discussing this with you, and If I accept the case, a contingency fee is customary. Based on the facts you've given, it sounds like a cse I'd be interested in. The carriers that insure most NY cabs, American Transit, Eagle, and All City/Empire, are difficult to deal with. Without an attorney you won't get far. In fact, I prefer that prospective clients do not contact insurance companies directly. If you were subject to an audit, would you call the IRS to discuss things with them. The anwswer likely is no. First let me express my concern to you and your husband about his health.
Second, you have probably been inundated by e-mails.
Third, check your own policy for rental coverage...some policies cover this. If you have collision, you insurance company will pay and seek to be reimbursed from the other car(s) for the damage caused.
All of these cases are taken on contingency, with expenses payable at the conclusion..this is the business norm and standard.
Your own insurance company no-fault should be paying his medical bills.
Seek legal representation because even with your own insurance company, they may look to stop paying his benefits under no-fault depending on how things are worded.

Your husband may sue the taxi that hit him for personal injuries. He is entitled to be compensated for his medical expenses, lost wages and pain and suffering. You may also have a claim in addition to the claim your husband has. You would each would sue the cab driver and cab company in one lawsuit. Their insurance company(ies) would appoint an attorney to represent them. While there is some chance that you may be able to recover a reasonable financial settlement on your own, the chance is probably very little. It is best that you be represented by an attorney.
