Legal Question in Personal Injury in New York

My car ys registered under my husbands name; i got hit in my car by a suv last month; since the person who hit my car didn't have insurance policy and was under influence, he requested to get an estimate and he will pay for damage; i got all his info and as per agreement faxed estimate and asked him to call back; never called me back, again a call and he told me that he changed his mind and that it was to much; i took my car to dealer to get it fix and paid for this and for car rental to do my commute to my job, all the invoices (dealer & rental) are under my name, my husband was with me at the time of accident and is my witness, all i need t know is who should sue this person- car registration under my husbands name, bills under my name- i appear in the dealer contract as a cosigner i don't know if this could help in order i can sue him since i was driving.

i'll appreciate your prompt advise

You don't say whether the accident was reported to police, or reported to your insurance carrier. At minimum, report the accident to your broker or insurance carrier NOW. Many auto policies include coverage for rental car expenses. See if yours does. If all that's involved is property damage and rental car expenses, the registered owner of the car should be the one making the claim. Rental expenses for your car can be included if the bill was paid from a joint account. If you paid the rental car bill from your own separate funds, add your name to the case caption. Best, M. E.
