Legal Question in Personal Injury in New York

do i have a case?

My son was playing basketball and broke his upper tibia. My doctor said that it could have been from an inbalance in the way his feet hit the ground. Prior to the season we had bought him some new nike basketball shoes. They have an inner boot and a skin that goes on the outside of them. We feel the sliding of his shoes could have caused the break. Do you feel that we have a case?

To create a products liability case out of these circumstances, you need an expert, up front, to establish the defect of the shoe. The defense will be that the play, the floor, and every thing else contributed to the accident.

Even if a defctive shoe, it will not generally be cost effective for an attorney to take such a case as the outlays of $$ up front provides very little return after the time factor is calculated into it.
