Legal Question in Personal Injury in New York

clery sexual abuse legal recourse

I was sexually abused by Catholic Clergy when I

was in a Catholic School and an Altar Boy. I was

11 Years old.

NY statute of limitations expired when I was 18. I

am in my 40's now.

However, my abuser left the State of New York

State well before I turned 18; and I've read recently

that the SOL is ''frozen'' if the offender leaves the

State where the crime took place.

Also, do I have Civil Lawsuit options - instead of

Criminal?

Answers to this - or any other advice - would be

greatly appreciated.

You should consult a New York state practitioner for clarification as to whether the statute of limitations is tolled or"frozen" to use your term

due to the alleged perpetrator's abscondance from the state.

The New York state lawyer should also be able to clarify whether your civil cause of action has survived the ensuing years to the present and just

as important, if it has so survived, when it will most likely expire.

If you chose to sue in civil court, the Catholic archdiocese responsible for the parish church

where the alleged abuse occurred, the alleged perpetrator priest, and any other individuals or institutions who may have aided or abetted in the

commission of these offenses could be named as respondents in your lawsuit.
