Legal Question in Personal Injury in New York

My daughter was in a car accident 2 years ago. She is fine but the other person was injured. Although that person is walking and back to work she is has a lawsuit against me for more money. I am not sure how much. My insurance is good for $300K. If she wins the case and wants more can she take all that I own including my savings and leave me destitute? Also, nobody was ever charged.

Attorneys very rarely go after one's personal assets unless the defendant is extremely wealthy or grossly underinsured and the plaintiff was seriously crippled or killed. In this case, it sounds as though this is not the case. The attorneys want to get as much money for their client as possible, and probably are suing for an amount in excess of the policy limit, but what they are usually seeking is to obtain the full amount of the policy.

In all likelihood, the case will be settled within the next year or two.
