Daughter Hit by Car Crossing Street in NYC
My 17 year old daughter was crossing the street at a crosswalk in NYC last weekend and was struck by a car. Besides bumps, bruises, scrapes and a potentially broken ankle, she is OK. As far as compensation, what are my options?

The car that hit her will provide medical coverage under its no-fault.
You can, and should, sue if there is a fracture, for the pain and suffering aspects and the limitations that the fracture will probably ultimately result in.

You need to get the no-fault application filed within 30 days of the accident. As for pain & suffering, you have to show "serious injury" as defined in the Insurance Law. A fracture qualifies as a matter of law. Bumps and bruises do not. Your daughter should receive medical attention and you should consult with an attorney. It is important to immediately file for no-fault benefits so that your daughter's medical expenses will be covered. She has 30 days to apply for those benefits with the insurance carrier for the car that hit her. In addition, I would suggest that you speak with an attorney regarding a claim being made against the owner and operator of that vehicle for the injuries sustained by your daughter.
