Legal Question in Personal Injury in New York
My daughter is being sued for a car accident. She has a personal injury lawsuit of her own pending from a different case. Can money she acquires from her personal injury lawsuit be taken as settlement for the lawsuit against her?

If the case against your daughter settles for a figure within her auto liability policy limits, all is well. If a jury verdict is rendered against her, within the policy limits, same result. If, however, a jury verdict is rendered against her in an amount higher than her auto policy limits, and a judgment is filed and given out for execution, all of her assets would be at risk, including money received, or to be received, from her own personal injury case.
