Legal Question in Personal Injury in New York

Can a doctor affiliated with and practicing at a hospital i'm suing ,operate on me for a lawsuit related injury. i think it is a conflict of interest.

Inform the physician of your pending lawsuit against the hospital.

There is no conflict if both parties are aware of the other's position and feel comfortable in proceeding with the rendition of services.
