Legal Question in Personal Injury in New York
Dragged 5 blocks by cab driver
My sisters and I flagged a yellow cab in manhattan one night. The cab driver complained most of the way about taking us to brooklyn. We gave directions before and during the ride. Near the end the driver passed the highway exit we indicated and had to double back. One of my sisters paid the fare while the other and I exited and went to the building. Looking back we noticed the driver and my sister arguing. I went back. The driver was upset my sister was copying his information. One hand resting on the window, I attempted to diffuse the situation when driver suddenly took off toward the highway. I yelled continuously please stop the car. I noticed a light turning red and prayed he would slow giving me a chance to let go but he pressed the gas and I let go afraid of my chances on the highway. Lacerations on hands, left side of my face and left thigh. 8 stitches above my left eye and hospitalized three days. My sister was treated and released from emergency. Driver info lost during the incident, witnesses at the scene noticed the traffc camera's flash when he ran the red light. Waiting to see if the driver has been found. I am filing claims w/MVAIC and crime victims board. What next?

You should have an attorney represent you. You certainly will do better monetarily. Do not give any statements to insurance carriers. If they determine the drivers acts were intentional MVAIC will not pay. If you or a member of your household owned a car when the accident occurred the claim must be filed with the insurnce carrier for that car not MVAIC. If you locate the taxi their insurance carrier should cover this accident if it is determined a negligent act. I practice in NY & FLa. Good luck.
