Legal Question in Personal Injury in New York
examination before trial
I have an on going personal injury case for the past year and a half. I have been told by
certain people that by this time my lawyer should have arranged my e.b.t
(examination before trial.) if this is true, when should this have been done?

Re: examination before trial
There is no set time frame in a personal
injury action for such procedures.
Depending upon the locale, this can take
years, if it is ever done at all. Many
times, I do not do EBT's because I know the
answers and have independent proof in case
the other party becomes unavailable
Re: examination before trial
Unfortunately, there is no set timetable for how cases proceed. It is possible that your opponents in the suit have not requested your EBT. It is their responsibility to depose you.
Personal injury cases can drag on and on. Don't lose heart, just try to be patient.

Hello--
This is by all means not true --- each case is different. Some travel faster..some slower..it all depends on the circumstances of your case.
