Legal Question in Personal Injury in New York
fall on sidewalk
My 77 year old mother fell on a sidewalk in front of a store about a block from my house getting off a bus. She fell down hit here head and hurt her ancle. someone helped her up and she proceded to walk the short block home and them had problems walking after that. She went to the doctor that afternoon who sent her to a radiology lab to have a cat scan and x-ray on the ancle. We just received the results and the head is ok and the ancle is not broked but is still swollen and black and blue the doctor referred her to a orthopaedic. The sidewalk is in terrible need of repair where she fell and I was wondering if we had any receourse considering there is no one except my mom to say that she fell there. Thanks

Re: fall on sidewalk
Your Mom will be the witness in her own action and testify to what happened. Such evidence alone can be enough to win a case. A witness helps, but is not necessary. The extent of her injuries determines the possible money amount recovered. The more serious the injury, the higher the amount as fair and adequate compensation. Good luck. Best, M. E. Zuller
