Legal Question in Personal Injury in New York
I had a fall OFF of stairs in my friend's apartment. I have multiple injuries including a separated shoulder I will need surgery on. She has stairs leading to the roof that are not up to code, however with guests over, we were using the stairs anyways. The landlord said not to use the stairs because they were not up to code, however he never fixed them. Is it possible to sue the landlord even though it was in her private rental residence or would she be the responsible party?

I am sorry to hear about your situation. There are several factors to consider. Yes, the landlord/owner will most likely be liable especially if they had prior notice of the condition. That issue needs to be investigated further. You need to take immediate pictures of the location to preserve it's condition. I suggest taking photos with today's newspaper as a backdrop to show the date. Was there any kind of report filed? Was ems called to the scene? Are there witnesses? There is lots to discuss.
